By your side when you need us most

We recognise that medico-legal matters can be demanding and stressful, both personally and professionally. That's why our highly qualified and experienced in-house legal team works in close partnership with you to resolve your particular matter as expediently as possible.

Where appropriate, our claims team will partner with external senior lawyers or engage directly with senior counsel, so you will have the most appropriate expertise matched to you specific needs, to ensure the best possible outcome.

Keep on practising with confidence

Last year saw an increase in targeted compliance with respect to co-claiming, for instance a professional attendance item billed with a diagnostic radiology item. Figurehead billing, MRIs, and SPECT scanning are other areas which appear to be under scrutiny, so please contact MDA National for advice if you receive correspondence from the Department of Health relating to Medicare billing, audit or compliance.

Other interesting medico-legal issues from last year include:

  • failure to report, or the under-reporting, of incidental findings
  • medico-legal issues arising from multi-disciplinary team meetings
  • the duty to access or review previous imaging
  • the timing and communication of urgent findings to the referring practitioner
  • the quality of images, and the reliance on radiographers and sonographers.

This year Ahpra published an updated Code of Conduct and also made some changes to the Guidelines: Mandatory notifications about registered health practitioners – publications we encourage you to read when you may have some time.
