Dr David Watson returns to MDA National Presidency

Do patients have a right to privacy after they have commenced litigation?

Doctors often obtain requests for information about their patients from various parties. This may include a request for a copy of the patient notes or a medical report. The request may come from the patient, someone acting on their behalf, such as their solicitor, or an insurance company. A recent case which was heard in the Supreme Court of NSW addressed the issue of whether patient's waive their right to confidentiality in relation to health information once they have commenced legal proceedings when their health information is relevant to the proceedings.
